Yamabe & Horn Engineering, Inc. (“Y&H,” “we,” “us,” or “our”) values your privacy. Please read this Privacy Notice carefully before using the yandhengr.com website (the “Website”). This Privacy Notice explains what information we may collect through the Website and how that information may be used. By accessing or using the Website, you acknowledge this Privacy Notice.

Personal Information Collected

We may collect and use information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked directly or indirectly, with a particular consumer or household (“personal information”). Personal Information does not include:

  • Publicly available information, including from government records, through widely distributed media, or that the consumer made publicly available without restricting it to a specific audience.
  • Lawfully obtained, truthful information that is a matter of public concern.
  • Information excluded from the California Consumer Privacy Act’s (CCPA) scope, like:
    • Health or medical information covered by the Health Insurance Portability and Accountability Act (HIPAA) and the California Confidentiality of Medical Information Act (CMIA), clinical trial data, or other qualifying research data; or
    • Personal Information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA), The Gramm-Leach-Bliley Act (GLBA), California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act.

Categories of Personal Information We Collect

In the preceding twelve (12) months, we may have collected the following categories of personal information: identifiers such as:

  • Your Name
  • Company name
  • Postal or project address
  • Phone number
  • Email address
  • Project or staking information
  • Professional or employment-related information (such as employment and educational information, résumés, and cover letters submitted with an employment application)
  • Internet or other electronic network activities (such as information included in messages, requests, or other form submissions)
  • Geological information; and inferences drawn from the foregoing.

Sensitive Personal Information:

In the preceding twelve (12) months, we may have collected the following categories of sensitive personal information relating to immigration or citizenship status, specifically:

  • Work authorization and sponsorship eligibility

However, we do not intentionally collect Social Security numbers, driver’s license, state identification cards, passport number, or other government identification number, account access credentials such as usernames, account logins, account numbers, or card numbers combined with access/security code or passwords, racial or ethnic origin, religious or philosophical beliefs, union membership, genetic data, biometric information for identification, health information, sex life or sexual orientation, or precise geolocation, unless we provide a separate notice and obtain consent where required.

Please do not submit passwords, social security numbers, financial account information, payment-card information, or other sensitive personal information unless Y&H specifically requests that information through an authorized process.

How We use the Information We Collect

We collect and use personal information to respond to inquiries, provide requested information, process and coordinate staking requests, review employment applications, maintain appropriate business records and operate and improve the Website. Information submitted through our Contact Us form is received and stored by Y&H.

Disclosure of Personal Information

We may disclose personal information to service providers and third parties that perform functions on our behalf, including Smartsheet (form processing staking requests and employment applications); and Google Analytics. See details below:

Google Analytics

This Website may use Google Analytics to help us understand Website traffic and how visitors use the Website. Google Analytics may collect technical information such as your IP address, browser or device type, operating system, pages visited, referring website, approximate geographic information, and interactions with the Website. Where required, Google Analytics will remain disabled until you make a selection through the Website’s privacy controls. If you would like to opt out of Google Analytics, you may use the Google Analytics Opt-out Browser Add-on.

Smartsheet Forms

Y&H uses Smartsheet to provide, process, and store information submitted through certain online forms, including our staking-request form and employment application.

When you submit one of these forms, the information you provide is transmitted through Smartsheet and stored within a Smartsheet account used by Y&H. Authorized Y&H personnel may access submitted information as necessary to process your request or application. Smartsheet may also collect technical, device, network, cookie, and usage information associated with its services. For more information about how Smartsheet handles information, please review the Smartsheet Privacy Notice. Some Smartsheet forms may use Google reCAPTCHA to help prevent automated spam and abuse. When reCAPTCHA is used, Google may receive technical and interaction information associated with your use of the form.

Selling or Sharing Personal Information

Y&H does not sell your personal information (including sensitive personal information) to third parties and have not sold it in the preceding 12 months. Y&H does not share your personal information with third parties for cross-context behavioral advertising, as those terms are defined under the CCPA and have not shared it in the preceding 12 months. We have not sold or shared the personal information of consumers, and we do not knowingly sell or share the personal information of consumers, including minors under 16 years of age.

Children’s Privacy

This Website is intended for a general business audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13 through the Website. If we learn that a child under 13 has submitted personal information without appropriate authorization, we will take reasonable steps to delete it.

Security and Retention

We use reasonable administrative, technical, and physical safeguards designed to protect information submitted through the Website. We may retain information for as long as reasonably necessary to respond to requests, maintain business and project records, administer employment applications, meet legal or professional requirements, and protect Y&H’s legitimate business interests.

Your California Privacy Rights and Choices

Subject to certain exceptions, California residents have the following rights:

Right to Know and Data Portability Requests:

You have the right to request that we disclose certain information to you about our collection and use of your personal information (the “right to know“), including the specific pieces of personal information we have collected about you (a “data portability request“).  You may exercise your right to know twice in any 12-month period. Once we receive your request and confirm your identity, we will disclose to you:

  • The categories of:
    • personal information we collected about you; and
    • sources from which we collected your personal information.
  • The business or commercial purpose for collecting your personal information and, if applicable, selling or sharing your personal information.
  • If applicable, the categories of persons, including third parties, to whom we disclosed your personal information, including separate disclosures identifying the categories of your personal information that we:
    • disclosed for a business purpose to each category of persons; and
    • sold or shared to each category of third parties.

When your right to know submission includes a data portability request, a copy of your personal information, subject to any permitted redactions.

Right to Delete and Right to Correct

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions and limitations (the “right to delete“). Once we receive your request and confirm your identity, we will delete your personal information from our systems unless an exception allows us to retain it. We will also notify our service providers, contractors, and other recipients to take appropriate action.

You also have the right to request correction of personal information we maintain about you that you believe is inaccurate (the “right to correct“). We may require you to provide documentation, if needed, to confirm your identity and support your claim that the information is inaccurate. Unless an exception applies, we will correct personal information that our review determines is inaccurate and notify our service providers, contractors, and other recipients to take appropriate action.

Right to Opt-out of the sale or sharing of personal information

You have the right to request that businesses stop selling or sharing your personal information at any time (the “right to opt-out“), including through a user-enabled opt-out preference signal. Similarly, the CCPA prohibits businesses from selling or sharing the personal information of consumers it actually knows are under 16 years old without first obtaining consent from consumers who are between 13 and 15 years old or the consumer’s parent or guardian for consumers under age 13 (the “right to opt-in“).

As we do not sell or share consumers’ personal data, we do not currently provide these consumer rights.

Right to Limit Sensitive Personal Information Use and Disclosure to Permitted SPI Purposes

You have a right to ask businesses that use or disclose your sensitive personal information to limit those actions to just the CCPA’s Permitted SPI Purposes (the “right to limit“).

In connection with a potential candidate’s employment application, we may collect work-authorization and sponsorship information that may reveal citizenship or immigration status. We use this information solely to evaluate your eligibility to work for us, determine whether immigration sponsorship may be required, administer the recruitment  and hiring process, comply with applicable legal obligations, protect against fraud or unauthorized activity, and for other purposes permitted by law.

We do not use or disclose this information to infer characteristics about you or for cross-context behavioral advertising. Accordingly, as we do not use or disclose sensitive personal information beyond the CCPA’s Permitted SPI purposes, we do not currently provide this consumer right.

If our practices change so that we use or disclose sensitive personal information beyond these permitted purposes, we will  provide any required notice and a method to exercise the right to limit.

Right to Non-Discrimination

You have the right not to be discriminated or retaliated against for exercising any of your privacy rights under the CCPA.

ADMT Rights

When a business uses automated decision-making technology (ADMT) to make significant decisions about you, you may have rights to:

  • Obtain certain information about how the business uses ADMT, that is specific to you (the “ADMT access right“).
  • Opt-out of the ADMT use (the “ADMT opt-out right“) unless the business provides you with a method to appeal the decision to a human reviewer with the authority to overturn the decision (the “ADMT appeal right“) or another exception applies.

ADMTs are technologies that process personal information and use computation to execute a decision and either replace or substantially replace human decision-making, resulting in decisions made without human involvement. Decisions are significant when they result in the provision or denial of financial or lending services, housing, education enrollment or opportunities, employment or independent contracting opportunities or compensation, or healthcare services. Advertising is not a significant decision.

We do not currently use ADMT to make significant decisions about consumers, so we do not provide ADMT access, opt-out, or appeal rights.

How to Exercise Your Rights

To exercise any of these rights, you may submit a verifiable consumer request through our Contact Us form or by using the contact information provided in the “Questions” section below. You may also designate an authorized agent to submit a request on your behalf; we may require the agent to provide proof of authorization and may require you to verify your identity directly with us.

Before responding to a request, we will take reasonable steps to verify your identity using the information associated with your prior submissions. We will confirm receipt of a verifiable consumer request within ten (10) business days and will respond with forty-five (45) days, which period may be extended by an additional forty-five (45) days when reasonably necessary, in which case we will notify you of the extension.

Changes to This Privacy Notice

We reserve the right to update this Privacy Notice at our discretion and at any time. If we make any material changes to this Privacy Notice, we will update the effective date and post the updated Notice on our website.
